Terms of Service

1. Acceptance of Terms

By accessing or using ScratchFrenzy — including the website at scratchfrenzy.app and the ScratchFrenzy mobile application for iOS and Android (collectively, the "Platform") — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. The Platform is owned and operated by EVQ AGENTIC LLC ("we," "us").

2. Eligibility

You must be at least 18 years of age to use ScratchFrenzy. By using the Platform, you represent that you meet this requirement and that lottery participation is legal in your jurisdiction.

3. Platform Description

ScratchFrenzy provides informational tools including expected value (EV) calculations, retailer maps, community inventory reporting, and lottery ticket scanning for personal record-keeping. The Platform is for informational and entertainment purposes only. We do not sell lottery tickets, operate any lottery, accept wagers, pay prizes, or facilitate the purchase or redemption of tickets. All lottery transactions occur outside the Platform between you and a state lottery or licensed retailer.

4. No Gambling Advice; No Guarantees

Nothing on ScratchFrenzy constitutes gambling advice, financial advice, or a recommendation to purchase any lottery ticket. EV calculations are estimates based on publicly disclosed prize odds and remaining prize counts and are not guarantees of any outcome. Inventory and "remaining prize" data is sourced from public state lottery disclosures and user submissions and may be incomplete or out of date. You play at your own risk.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when registering. You may delete your account at any time from Profile → Delete Account in the Mobile App, from the /delete-account page on the website, or by emailing support@scratchfrenzy.app. Deletion is described in our Privacy Policy.

6. Subscriptions (ScratchFrenzy Pro)

6a. Subscription terms

ScratchFrenzy offers an optional paid subscription, "ScratchFrenzy Pro," that unlocks additional features. Subscriptions are offered as monthly and annual plans. The price, duration, and any free-trial period for each plan are shown to you at the point of purchase.

6b. Billing through the App Store / Google Play (Mobile App)

Subscriptions purchased in the iOS Mobile App are billed by Apple through your App Store account. Subscriptions purchased in the Android Mobile App are billed by Google through your Google Play account. Payment is charged to your Apple ID or Google account at confirmation of purchase.

6c. Auto-renewal

Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

6d. Managing and cancelling your subscription

• iOS: open the App Store app → tap your profile → Subscriptions → ScratchFrenzy → Cancel Subscription. (See support.apple.com/HT202039.)
• Android: open Google Play → Account → Payments & subscriptions → Subscriptions → ScratchFrenzy → Cancel.
• Web (Stripe): open Profile → Manage Subscription on scratchfrenzy.app.

Cancellation takes effect at the end of the current billing period; you keep Pro access until then.

6e. Refunds

Refund requests for App Store subscriptions are handled by Apple at reportaproblem.apple.com. Refund requests for Google Play subscriptions are handled by Google through the Play Store. Refund requests for web subscriptions can be made by emailing support@scratchfrenzy.app; we evaluate refunds at our discretion, subject to applicable law.

6f. Price changes

We may change subscription prices. Material price changes will be notified in advance through the Platform or by email, and where required, your renewal will not proceed without your affirmative consent to the new price.

7. License to Use the Mobile App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Mobile App for personal, non-commercial use on devices you own or control. If you download the Mobile App from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (the "Standard EULA," available at apple.com/legal/internet-services/itunes/dev/stdeula), which is incorporated into these Terms with respect to your iOS use.

8. Apple App Store Additional Terms

The following additional terms apply if you obtain the Mobile App from the Apple App Store:

• These Terms are an agreement between you and EVQ AGENTIC LLC only, and not with Apple. Apple is not responsible for the Mobile App or its content.
• The license granted to you is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the Mobile App.
• To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Mobile App. Any claims, losses, liabilities, damages, costs or expenses attributable to any failure of the Mobile App to conform to any warranty are our sole responsibility.
• We are responsible for addressing claims by you or a third party relating to the Mobile App, including product liability, failure-to-conform, and intellectual property claims.
• You represent that you are not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them as they relate to your use of the Mobile App.

9. User-Submitted Content

By submitting inventory reports, ticket scans, or other content to the Platform, you grant EVQ AGENTIC LLC a non-exclusive, royalty-free license to use, store, process, and display that content within the Platform for the purpose of operating and improving the service. You represent that your submissions are accurate to the best of your knowledge.

10. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose, or to facilitate purchase, sale, or redemption of lottery tickets in violation of applicable law.
• Submit false or misleading inventory reports.
• Upload images that are not lottery tickets, or that contain personal information of others without consent.
• Attempt to scrape, reverse-engineer, decompile, or otherwise interfere with the Platform.
• Use automated tools to access the Platform at unreasonable rates.
• Resell or commercially redistribute Platform data without our written permission.

11. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any data displayed is accurate or current.

12. Limitation of Liability

To the maximum extent permitted by law, EVQ AGENTIC LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. Our aggregate liability for any claim related to the Platform shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) US$50.

13. Responsible Gaming

14. Termination

You may stop using the Platform at any time and delete your account as described in Section 5. We may suspend or terminate your access if you violate these Terms or for legal or security reasons.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Delaware, unless required otherwise by applicable consumer protection law.
